Employers traditionally create policies to proscribe negative conduct when laws compel them. However, 75% of harassment is legal -- the kind that is not "status-based." For that reason alone, employers do not have policies to address Bullying.

A good Policy is the cornerstone of a civil workplace. It sends the right message that destructive interpersonal misconduct is no way to run a successful, sustainable business in the long run. It ensures prevention of bullying.

Policy Creation is the centerpiece of The Work Doctor® Blueprint for a Bullying-Free Workplace Program. If your organization wants to have only one service, this is the indispensable one.

The Work Doctor consultant (Dr. Gary Namie for most clients) leads the group through a proven, structured, proprietary process that guarantees the work is completed in the designated timeframe, optimizing results for all participants. In addition, the veteran consultant shares lessons learned from sabotaged initiatives when improperly implemented.

There are three results/deliverables:
a. A custom, internal, loophole-free Policy to specifically address Workplace Bullying, either as a stand-alone code or one that expands existing codes and policies.

b. Enforcement is the set of Complaint-Response-Remedy procedures that implement the Policy. Personal and organizational accountability will result. Creating these procedures poses the greatest challenge. It is imperative that the Policy be applied throughout the organization without exception in order to be effective and credible.

c. A Introduction-Rollout Plan: Training & Education for all employees, supervisors and administrators
Because Policies without Enforcement always fail, we do not offer a Policy-only service. Even the courts believe that enforcement of policies is critical to avoid liability. A New York trial judge upheld a $2.5 million jury award to a terminated employee [Jordon v. Bates Advertising Holdings Inc. (N.Y. Sup. Ct. 2006)]. In that case, the defendant company relied on its antidiscrimination policy as a mitigating "safe harbor." However, the trial judge said that "simply promulgating anti-discrimination policies and having them inserted in the company's policy book cannot serve as a mitigating factor." In other words, having a policy without faithfully enforcing it is an inadequate defense from vicarious employer liability.

Finally, Work Doctor's involvement with legal aspects of bullying also assures Clients of satisfactory compliance with future government regulations or anti-bullying laws.

A diverse Policy-writing group is assembled with representatives from human resources, risk management, legal counsel, unions, non-supervisory employees, and management. The process typically takes two days, depending on the size of the designated internal writing group. The group has to be granted authority to execute the results it created.
